 TYPES OF DATA COLLECTED 

The personal data that Punto Exe Srl collects directly or through third parties are:  

Data collected directly: these are those provided by the subject (User) when registering on the Site: name, surname, date of birth, email address and telephone number, or other data, such as other particular data aimed at specifying the reason why one wishes to use the service, entered voluntarily (and in any case not necessary) by the User via the contact forms, during navigation of the site itself.  

Indirectly collected data: this data comes from services used by the User, technical data such as IP address, browser type, information about the computer being used, data relating to the current (approximate) location of the device the User is using, data collected using cookies or similar technologies. Any use of cookies—or other tracking tools—by Punto Exe Srl or the owners of third-party services used by this service, unless otherwise indicated, will serve to identify users and remember their preferences, for the sole purpose of providing the service requested by the user. Failure to provide certain personal data may result in Punto Exe Srl being unable to provide its services. Users are responsible for any personal data obtained from third parties, published, or shared with this platform, and confirm that they have given their consent to its use. 

While using the service, audio and video recordings may be made, which may also include information about the patient’s emotions and summarized in a report. However, these recordings will only be accessible to the authorized professional, and not to Punto Exe Srl. 

While using the Services, you may also be asked to enter information relating to payment methods, such as Stripe, PayPal or credit card in various sections of the Site. 

 

Special Categories of Personal Data Various sections of the platform include fields where you can provide Punto Exe Srl (voluntarily or not, depending on the service you are requesting) certain special categories of Personal Data, such as data revealing racial or ethnic origin, political opinions, religious or philosophical beliefs, trade union membership, genetic data, biometric data intended to uniquely identify a natural person, data concerning health or data concerning a person’s sex life or sexual orientation. 

The use of cookies by the PsyCare portal, unless otherwise specified, is solely for the purpose of providing the service requested by the User, in addition to the other purposes described in this document and in the Cookie Policy. We avoid profiling the User in any case. 

 

PURPOSE OF DATA PROCESSING AND DATA STORAGE PERIOD 

We pursue the specific purposes that we indicate in detail below: 

PURPOSE 1: respond to requests from interested parties, fulfill contractual and pre-contractual obligations, and comply with legal obligations. 

PURPOSE 2: Purposes functional to the development of the Company’s activities, for which the user has the option to provide or withhold consent (“Marketing”; optional consent). This category includes the following activities: 

send marketing communications, promotions and advertising, market research and surveys, via email, SMS, postal mail, telephone, banners, instant messaging, through an operator, through social media pages; 

send customers, including through third-party companies responsible for data processing, informational or promotional material relating to services of any nature provided by third parties, with whom the Company has entered into commercial agreements to be offered to its customers; 

verify the level of customer satisfaction with the services provided by the Company, also by using market research companies or, in any case, specialized companies, which may send questionnaires to samples of customers to fill in or other material suitable for this purpose. 

 

STORAGE OF PERSONAL DATA: 

Personal data is processed using manual, computerized, and electronic means, using methods strictly related to the purposes indicated above and, in any case, in a manner that guarantees the security and confidentiality of the data and for the time strictly necessary to fulfill the purposes for which it was collected, in compliance with privacy and applicable regulations. 

With reference to data collected by the Data Controller for requests from the interested party, performance of contractual, pre-contractual, or legal obligations: The Data Controller will retain the database for the time necessary to manage the activities related to data processing. 

With regard to institutional information activities: data subjects’ data will be retained for the time necessary to carry out the activity, avoiding indefinite retention and facilitating the exercise of their rights by the interested party. 

 

Data processed for marketing and third-party communication purposes will be retained until the interested party withdraws their consent. Data processed for statistical purposes will be retained for a maximum of 24 months. 

 

LEGAL BASIS FOR DATA PROCESSING 

 

The legal bases used by Punto Exe Srl to process data, according to the purposes indicated in the previous paragraph, are as follows: 

Service Provision: Processing for this purpose is necessary to provide the Services and, therefore, to execute the contract. It is not mandatory to provide Punto Exe Srl with your personal data for this purpose, but otherwise it will not be possible to provide some or all of the Services. Management of legal obligations: Data is also processed to manage any legal obligations, and this legal basis legitimizes processing for this purpose. 

Marketing: Processing for this purpose is based on a separate, explicit consent. It is not mandatory to provide consent to Punto Exe Srl for this purpose, and you are free to withdraw it at any time without any consequences (other than no longer receiving marketing communications). You may withdraw your previously granted consent by following the instructions in the following section of this Policy. 

 

RECIPIENTS TO WHOM PERSONAL DATA WILL BE DISCLOSED 

 

entities that typically act as data controllers, namely: i) individuals, companies, or professional firms that provide assistance and consultancy to Punto Exe Srl in accounting, administrative, legal, tax, financial, and debt collection matters relating to the provision of the Services; 

subjects with whom it is necessary to interact for the provision of the Services (for example the doctor, who acts as an independent controller); 

persons delegated to carry out technical maintenance activities (including maintenance of network equipment and electronic communications networks); 

persons authorized by Punto Exe Srl to process Personal Data necessary to carry out activities strictly related to the provision of the Services, who have undertaken to maintain confidentiality or have an adequate legal obligation of confidentiality (e.g. Punto Exe Srl employees and consultants); 

subjects, entities or authorities to whom it is mandatory to communicate your Personal Data for the purposes of controlling abuse or fraud, or by order of the authorities. 

 

RIGHTS THAT BELONG TO THE USER WHEN HE INDICATES HIS PERSONAL DATA 

 

The user has the right to: 

  • access your data. 
  • ask for rectification 
  • request cancellation 
  • object to the processing 
  • change your consents 
  • request the limitation of processing 
  • request data portability. 

 

Each user can exercise their rights directly and free of charge by contacting the following email address support@psycare.it  by indicating in the subject line of the email: “RIGHTS REGARDING PERSONAL DATA” specifying which right you are requesting, or by written communication to the Data Controller’s address. 

This request must include the date, name, surname, type of request, and address for notification purposes. To avoid any misunderstanding regarding the identity of the individual requesting to exercise their rights, the Data Controller reserves the right to request a copy of their identity document to confirm the requester’s identity when necessary. 

Users have the right to lodge a complaint with the Italian Data Protection Authority (Garante per la protezione dei dati personali) at www.garanteprivacy.it.
